1. Acceptance of Terms
By accessing or using the services provided by The Average Company UI OS Inc. ("The Average Company", "we", "us", or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.
2. Sovereign Infrastructure
The Average Company provides cloud infrastructure, LLM APIs, and developer tools ("Services"). Because our services are deeply integrated into India's sovereign data ecosystem, you agree to:
- Comply with all applicable Indian data residency and localization laws (e.g., DPDP Act).
- Ensure that any highly sensitive personal data uploaded to our servers is appropriately encrypted.
- Not use our sovereign infrastructure to bypass any lawful interception requests mandated by national security protocols.
3. User Accounts and Security
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You must notify us immediately of any unauthorized access.
4. Intellectual Property
All content on this website, including software, code, models, text, graphics, and logos, is the property of The Average Company. You may use our open-source models as dictated by their specific open-source licenses, but access to our proprietary APIs and enterprise dashboards remains strictly under our copyright.
5. Payment and Billing
Fees for our enterprise API usage and dedicated cloud instances are billed monthly. Failure to pay within 15 days of the invoice date may result in immediate suspension of API keys. All fees are exclusive of applicable GST.
6. Limitation of Liability
Our services are provided "as is" and "as available". To the maximum extent permitted by law, The Average Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
7. Governing Law
These terms are governed by the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
